Website and Services TERMS OF USE The use of this website and the use of Pony Express Courier Canada Inc. delivery services form an agreement to the Terms & Policies set herein. Pony Express Courier Canada Inc. reserves the right to update the Terms & Policies at any time without notice. Delivery services are intended solely for use by businesses operating within Ontario, Canada and/or residents of Ontario, Canada that have an approved account with Pony Express Courier Canada Inc. Notwithstanding the fact that the site may be accessed by residents of other jurisdictions, Pony Express Courier Canada Inc. should expressly disclaim any representation or implication that the site or the information contained therein is available for use in, is appropriate in form and content for, or comply with the laws of any jurisdiction other than Ontario, Canada. DELIVERY SERVICES Pony Express Courier Canada Inc. is based in Mississauga, Ontario and delivers small and large packages by means of independent contractors throughout the GTA and Ontario. We do not pick up or ship dangerous goods. The goal and intent of Pony Express Courier Canada Inc. is to provide a timely and complete delivery service for it's cliental. A complete delivery would usually mean a delivery that has been received and signed for. However due to unforeseen circumstances, many times a delivery can arrive at its destination with no one available to sign for the items. This would be considered an attempted delivery in which the client will be charged for the additional service of redelivery. A Customer Service Representative on behalf of Pony Express Courier Canada Inc. may and usually will give a courtesy call to the client to inform them of the circumstance, but at no time is under obligation or responsible to do so. In relation to the foregoing and at its own and good and reasonable discretion, Pony Express Courier Canada Inc. may also choose to retain the order with the option of redelivery at their earliest convenience or may seek direction from the client as to the best delivery method. Pony Express Courier Canada Inc. may choose an alternate means or route with the goal once again of delivering in a timely and complete manner. Pony Express Courier Canada Inc. therefore disclaims any liability and will not be held responsible for consequences which could result in an untimely delivery and/or failure to deliver. Any other conditions beyond control that could result in an untimely delivery or failure to deliver include traffic delays and accidents, road closures and road construction, weather conditions, items not available or ready at the time of order, misdelivery due to incorrect information given by the client or client's representatives and any other unforeseen incidental delays. All delivery service times noted are presented as reasonable guidelines and as such are not guarantees that a delivery will be done within the expected time. These guidelines help the client and or the client's respresentatives to consider the most appropriate service for their delivery. Pony Express Courier Canada Inc. through its group of contractors do have an outstanding record of on-time delivery well within these guidelines to date. Pony Express Courier Canada Inc. take necessary and reasonable precautions in hiring independent contractors so when client items are picked up, in transit, and delivered, there is limited risk of damage or loss of an item. Due to unforeseen circumstance Pony Express Courier Canada Inc. will hold and holds no responsiblity for such foregoing matters and disclaims any liability that may result in damage or loss to any item. At this time Pony Express Courier Canada Inc. does not provide insurance on client deliveries. PAYMENT OF SERVICES Invoices are payable upon receipt. Pony Express Courier Canada Inc. at it's appropriate discretion may apply a fee to offset costs associated with late payments and adjustments, which is billed on the next consecutive invoice. Thereafter, accounts in arrears will be re-evaluated and current discounts may not apply or may be adjusted accordingly. All delivery services are subject to GST and a variable fuel surcharge. RATES AND SALES POLICIES Pony Express Courier Canada Inc. is committed to providing it's clients with competitive and fair rates. Pony Express Courier Canada Inc. as an operative organization requires that these rates are to be solely used for the purpose intended. Rates are subject to change with no prior notice. To obtain our basic GTA rates please leave relevant information such as company name, contact and phone number in order to arrange an appointment with a Sales Representative within 2-3 business days.
